Waiver and Release of Liability and All claims by Client
I acknowledge that I have been advised prior to my commencement of participation in cardiovascular, weight and resistance personal training programs in person or online with Steven Yates and all Architect Fitness employees/trainers that it could result in physical injury. I fully understand and acknowledge that these activities have:
Potential risk, dangers, and hazards and such exists in my use of any equipment and my participation in these activities. Further, that there may be other risks not known or not reasonably foreseeable at this time.
My participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disabilities. I hereby assume full responsibility for all the foregoing risks, known and unknown and accept responsibility for the damage following any injury, partial or permanent disability, or death.
These risks and dangers may be caused by the negligence of the personal trainers, negligence of the facility in which training is performed, representatives, employees, or volunteers of the personal trainer, the negligence of the participants, the negligence of others, accidents, breaches of contract, malfunction of equipment or other causes.
By my participation in these activities and for use of equipment, I hereby assume all risks and dangers and all reasonability for any losses and/or damages where caused in whole or in part by the negligence or the conduct of the representatives, employees, or volunteers of Steven Yates.
I understand that a physician's approval is highly recommended prior to participating in any fitness exercise program.
On behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify Steven Yates and his representatives, employees, and volunteers from any and all claims, actions or losses of bodily injury, property damage, wrongful death, losses of services, lawsuits, attorney's fees and costs, or otherwise which may arise out of my use of any equipment or participation in these activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently, or in the future, for the negligent acts or other conduct by the representatives, employees, and volunteers of Steven Yates.
I have read the above waiver and release and by signing it acknowledge and represent that I am 18 years of age or older and voluntarily consent to the contents of this document. I agree that by executing this waiver and release, I am giving up my right to bring legal action or assert a claim against Steven Yates and representatives, employees, and volunteers of Steven Yates for trainer's negligence, or for any defective product used while receiving personal training from the trainer. It is my intention to exempt and relieve Steven Yates from liability for personal injury, property damage or wrongful death caused by negligence or any other cause.
